Bachmann vows to stay in GOP race despite setbacks (AP)

DES MOINES, Iowa ? Vowing to press ahead through the Iowa caucuses, Republican Michele Bachmann dismissed the notion Thursday that her presidential campaign was in disarray ? even as she lost another staff member.

Her comments came a day after a key supporter fled her campaign and she had to fend off other calls to leave the race for the GOP nomination. On Thursday, Wes Enos said he was leaving his job as Bachmann's political director, saying: "I am no longer serving in an official capacity with the campaign." He said he doesn't plan to work for or support another candidate and still plans to caucus for Bachmann.

Despite all that, the Minnesota congresswoman called her campaign organization "strong" and said her headquarters had received 150 calls of support after her Iowa campaign chairman, state Sen. Kent Sorenson, resigned and switched his allegiance to rival Ron Paul on Wednesday.

Sorenson made the switch a few hours after appearing with Bachmann. She alleges he was offered "a lot of money" to change sides, an inducement she said Sorenson had told her about during a telephone conversation on Tuesday.

"I know what I was told in that conversation," Bachmann said.

The Paul campaign and Sorenson denied that money factored into the decision or that any such offer was made.

Sorenson told CNN on Thursday that he wanted to back a candidate who is in a position to keep Mitt Romney from winning Iowa. "It's unfortunate they're resorting to these type of tactics," Sorenson said. "But the fact of the matter is she wasn't going to win Iowa."

Quadrocopters don creepy eyes, build synthetic Christmas tree of envy (video)

First we let them play music, then they started juggling. Now quadrocopters are feeling emotions as well; namely, jealousy. One of Flying Machine Arena's dainty quadrocopters, nicknamed Juliet, was compelled to build its own synthetic Christmas tree after spying an authentic fir through a glass window. Sure, stacked bricks of festive foam seem innocent enough, but look into those ping-pong ball eyes and tell us you aren't a little worried that next year's "war on Christmas" will be the machine's war on humans. Fly past the break to see Juliet's envious construction project for yourself.

Domestic policy chief starts, leaves amid crises

(AP) ? Melody Barnes is leaving as White House chief domestic policy adviser at a time when President Barack Obama's administration is getting little notice for its work on the home front to fix the struggling economy.

Barnes, who will be gone by Tuesday, is quick to point out that there have been many domestic achievements, even though the public is dissatisfied.

"I completely understand what the American public is feeling," she said in an interview in her tidy West Wing office. "Real people are hurting in a significant way. ... At the same time, I'm proud of the things we've been able to accomplish over the last few years."

Her office is wrestling with multiple thorny issues now just as it was when Barnes started as Obama's domestic policy team director in 2009.

Back then, the economy plunged into free-fall and the country was in its worst economic crisis since the 1930s. Jobs were being lost at a rate of about 750,000 a month ? a number Barnes still finds so staggering she said she has to double-check it every time she says it.

Homes were being foreclosed, unemployment was skyrocketing and reaching double the national average in the black community. The wars in Iraq and Afghanistan dragged on, an outbreak of H1N1flu virus became a pandemic, and a tsunami that hit Japan crippled a nuclear plant near Tokyo, to name some of the highlights.

Even her chance to play golf with the president, the first time a woman joined him, was a response to what was a public image crisis for Obama. The president was getting flak for playing basketball with men and fostering complaints about a boys' club in the White House.

Just before Christmas, the president and Congress wrangled over a two-month extension of a Social Security payroll tax cut and unemployment benefits. Obama won a victory when the proposal won bipartisan support in the Senate and finally was accepted by House Republicans under extreme pressure.

Barnes, a Richmond, Va., native with a career in government and private sector work, is bowing out of the political arena as Obama struggles with low approval ratings on his handling of the economy.

A majority of Americans do not think the president deserves a second term, according to the most recent Associated Press-GfK poll. But at the same time, the unemployment rate has dropped to 8.6 percent, the lowest level since March 2009. The president's overall approval rating stands at 44 percent, the lowest of his term in AP-GfK surveys.

His strong stance against House Republicans in the payroll tax standoff has caused an uptick in approval ratings in subsequent polls.

Barnes expects the list of legislative victories that she and others pulled off amid the hemorrhaging economy will become more clear in the coming year as the dark clouds of the economy disperse.

She tops that list with the early work to stabilize the economy, 21 months of consistent job growth and the president's long-term investments in education overhaul, an area that became her specialty.

"Our work on education reform, it'll be part of this president's legacy," she said.

Barnes said that with a fraction of what the federal government spends annually on education, about $100 billion, from the American Recovery and Reinvestment Act of 2009, the administration tapped into an education reform movement taking place at the grass roots among governors and local communities frustrated with the prescriptive, one-size-fits-all mandates of No Child Left Behind, the Bush administration's education cornerstone.

Congress has yet to approve revisions to No Child Left Behind, states are using up the stimulus money, and Obama's Race to the Top grant program faces spending cuts. But Barnes said Obama has given a boost to education law changes that now allow such things as connecting student performance and teacher evaluations.

Barnes, chief counsel to the late Sen. Edward Kennedy on the Senate Judiciary Committee, said Obama also deserves credit for passage of a health care overhaul, legislation that she had worked on for eight years with Kennedy. The Massachusetts senator spent his career trying to restructure health care.

There's also the auto industry bailout, expansion of Pell grants to help fund college education, the end of the military's "don't ask, don't tell" policy on gays and work to advance civil rights, she said.

"When you are worried about day to day, it's hard to step back and to take all those other things in," Barnes said. "Although at the same time, I'm literally in the grocery store and people come up to me and say, 'Hey, you work for the president. You keep on doing what you are doing.' "

Married a few months into the president's first year, Barnes plans to spend more time with family. She is considering offers in the private sector but hasn't disclosed what those are.

Oil inches up toward $100 as US economy improves (AP)

SINGAPORE ? Oil prices inched higher toward $100 a barrel Friday in Asia amid encouraging signs the U.S. economy is slowly improving.

Benchmark crude for February delivery rose 23 cents to $99.88 a barrel at late afternoon Singapore time in electronic trading on the New York Mercantile Exchange. The contract added 29 cents to settle at $99.65 in New York on Thursday.

In London, Brent crude was up 11 cents at $108.13 a barrel on the ICE Futures exchange.

Crude has traded near $100 since mid-November after jumping from $75 in October as investors eye growing evidence the U.S. economy could avoid a recession next year. The government reported Thursday that claims for jobless benefits fell to a four-week average of 375,000, the lowest level in three and a half years.

The National Association of Realtors also reported that contracts to buy U.S. homes rose last month to the highest level in a year and a half.

Some analysts worry Europe's debt crisis will drag the continent into recession next year and undermine global crude demand.

"From a longer term perspective, we continue to zero in on the euro zone as the primary driver of oil pricing during the first quarter of 2012," energy consultant Ritterbusch and Associates said in a report. "We still view the euro zone debt issues as intractable."

Traders are also closely watching tensions between Iran and Western powers over Tehran's nuclear power program. Iran threatened this week to close the key oil export passage of the Strait of Hormuz in the Persian Gulf if the U.S. and other nations tighten sanctions. The U.S. Navy said it would not tolerate any move to limit the strait's traffic.

Energy trader Blue Ocean Brokerage said oil prices would likely eventually jump by about $50 if Iran, OPEC's second-biggest crude exporter, tried to close the strait.

"Let's start with an easy $20 spike, then add in a risk premium for insurance costs, delays, costs to push oil through alternative routes and the obvious loss of 3.5 million barrels a day from Iran," energy trader Blue Ocean Brokerage said in a report.

Trading volume was low this week as many investors take vacations around the Christmas and New Year's Day holidays.

In other Nymex trading, heating oil rose 0.7 cents to $2.93 per gallon and gasoline futures gained 0.7 cents at $2.68 per gallon. Natural gas futures were down 1.2 cents to $3.02 per 1,000 cubic feet.

Former Microsoft Exec Explains Windows Phone?s Failure

Charlie Kindle, a former General Manager for the Windows Phone team at Microsoft, recently posted an entry to his blog in which he explains what he believes are the main reasons why Windows Phone has not been a commercial success. Despite numerous positive reviews for the mobile OS, an app market that continues to boom and just exceeded the 50,000 app mark, and affordable devices available on virtually every major carrier, Windows Phone?s market penetration continues to disappoint.

In the rant, Mr. Kindle, who is no longer with Microsoft, says, ?In the mobile device space the four primary sides of the market are not actually aligned very well. In fact, there is such deep misalignment that there is great instability. Android has succeeded (in raw unit numbers at least) by capitalizing on that misalignment. Apple has attempted to change the game by cutting out one of the sides of the market.? Then he goes on to say that Microsoft?s approach causes more friction with both carriers and device manufacturers than competing platforms (in not so many words), and that the friction prevents both the carries (who control major marketing dollars and the retail sales processionals responsible for actually selling the devices) and the device manufacturers from fully embracing Microsoft?s mobile platform. A platform which many?including Charlie Kindle?feel offers a better end-to-end experience than Android.

The HTC Tital Running Windows Phone

Microsoft?s more controlling approach essentially dictates what the hardware specifications for a device should be, much to the chagrin of the device manufacturers. And Microsoft also dictates to the carriers how, and to some extent, when devices will be updated. The end result is that the Windows Phone experience from device to device is consistent and that in the last update cycle, when Mango was rolled out, almost every Windows Phone device got an update, virtually eliminating the fragmentation that?s rampant with Google?s Android. Kindle believes that it?s these restrictive policies that have made device manufacturers reluctant to fully embrace Microsoft?s mobile platform and carriers reluctant to stand behind it and incentivize their retail sales force to push the platform.

Kindle goes on to say, ?This is why, despite being a superior PRODUCT to Android, Windows Phone has not sold as well.? Spending marketing dollars on advertising Android devices is (an) easy decision for the carriers.?

Considering Kindle?s history and understanding of the mobile market, his opinions obviously hold some water. However, I think there are other factors at play as well. In addition to being more open and allowing both carriers and device manufacturers to customize Android, Android?s other advantage (at least currently) is that it offers a more affordable alternative to iOS, while still maintaining the look and feel of Apple?s product. Whether Android?s or iOS? interface elements are superior is a matter for another debate, but most consumers? perception that Apple?s product has it ?right? makes them more open to Android in my opinion. In comparison, Windows Phone?s interface takes things in a completely different direction and can be jarring at first glance.

Consumers are also reluctant to try Windows Phone because at this point it offers little incentive over competing products. If they?re not enamored by the interface, why would someone buy a Windows Phone over an iPhone or the myriad of excellent Android-based devices? As of today, there is little incentive--there are more apps for iOS and Android, more varied devices (for android), and the hardware is more cutting edge on competing platforms. Whether or not that changes once Windows 8 ships remains to be seen, but it?s clear that it?s going to take more than persistence for Windows Phone to gain any real traction with consumers.

Trademark Watch: What Is ?Yahoo Axis??

yahooLast Friday, troubled Internet giant Yahoo filed a new trademark application with the USPTO. I can't find any record of an existing Yahoo product or service by the name, so I figured I should just throw it out here for all of you to speculate what the company has up its sleeves. The name, before I forget to mention it, is Yahoo Axis. That will make you none the wiser, but perhaps the classes and descriptions might.

Worst year in decades for elephants

JOHANNESBURG (AP) ? It's been a disastrous year for elephants, perhaps the worst since ivory sales were banned in 1989 to save the world's largest land animals from extinction, the wildlife trade monitoring network TRAFFIC said Thursday.

A record number of large seizures of elephant tusks represents at least 2,500 dead animals and shows that organized crime ? in particular Asian syndicates ? is increasingly involved in the illegal ivory trade and the poaching that feeds it, the group said.

Some of the seized tusks came from old stockpiles, the elephants having been killed years ago. It's not clear how many elephants were recently killed in Africa for their tusks, but experts are alarmed.

TRAFFIC's elephant and rhino expert Tom Milliken thinks criminals may have the upper hand in the war to save rare and endangered animals.

"As most large-scale ivory seizures fail to result in any arrests, I fear the criminals are winning," Milliken told The Associated Press.

Most cases involve ivory being smuggled from Africa into Asia, where growing wealth has fed the desire for ivory ornaments and for rhino horn that is used in traditional medicine, though scientists have proved it has no medicinal value.

"The escalation in ivory trade and elephant and rhino killing is being driven by the Asian syndicates that are now firmly enmeshed within African societies," Milliken said in a telephone interview from his base in Zimbabwe. "There are more Asians than ever before in the history of the continent, and this is one of the repercussions."

All statistics are not yet in, and no one can say how much ivory is getting through undetected, but "what is clear is the dramatic increase in the number of large-scale seizures, over 800 kilograms (1,760 pounds) in weight, that have taken place in 2011," TRAFFIC said in a statement.

There were at least 13 large seizures this year, compared to six in 2010 with a total weight just under 1,000 kilograms (2,200 pounds).

In the most recent, and worst, case Malaysian authorities seized hundreds of African elephant tusks on Dec. 21 worth $1.3 million that were being shipped to Cambodia. The ivory was hidden in containers of handicrafts from Kenya's Mombasa port. Most large seizures have originated from Kenyan or Tanzanian ports, TRAFFIC said.

Fifty elephants a month are being killed, their tusks hacked off, in Tanzania's Selous Game Reserve, according to the Washington-based Environmental Investigation Agency.

With shipments so large, criminals have taken to shipping them by sea instead of by air, falsifying documents with help of corrupt officials, monitors said.

Milliken said some of the seized ivory has been identified as coming from government-owned stockpiles ? made up of confiscated tusks and those of dead elephants ? in another sign of corruption.

"In 23 years of compiling ivory seizure data ... this is the worst year ever for large ivory seizures. 2011 has truly been a horrible year for elephants," said Milliken.

Rhinos also have suffered. A record 443 rhino were killed in this year in South Africa, compared to 333 last year, according to National Geographic News Watch. South Africa is home to 90 percent of the rhinos left on the continent.

Africa's elephant population was estimated at between 5 million and 10 million before the big white hunters came to the continent with European colonization. Massive poaching for the ivory trade in the 1980s halved the remaining number of African elephants to about 600,000. Following the 1989 ban on ivory trade and concerted international efforts to protect the animals, elephant herds in east and southern Africa were thriving before the new threat arrived from Asia.

A report from Kenya's Amboseli national park highlighted the dangers. There had been almost no poaching in the park, which lies in the shadow of Mount Kilimanjaro, for 30 years until a Chinese company was awarded the contract to build a highway nearby two years ago. Amboseli has lost at least four of its "big tuskers" since then.

Saints' Brees blows through Falcons, breaks NFL passing record

"This record isn't about one person. There might be just one name that goes in ledger under the record, but it's really about the team," Brees told his teammates. "I want everyone to feel a huge part of this, that this record would not have been possible without them."

It was quite a night for Brees and the Saints - a record and a rout.

Brees set the NFL mark for yards passing in a season, breaking a record Dan Marino held for 27 years, and New Orleans (12-3) wrapped up the NFC South title with a 45-16 victory over the Atlanta Falcons last night.

Brees nearly topped Marino three years ago, finishing with 5,069 yards passing. But that pursuit rang a little hollow because the Saints were 8-8.

This time, Brees' prolific passing has led New Orleans (12-3) to the playoffs and a legitimate shot at its second Super Bowl in three seasons.

"We all want this (record) very badly," Brees began, "but it's all about winning and we know if we just focus on that, all that other stuff will take care of itself."

Brees threw for 307 yards and four touchdowns, the last a 9-yard strike to Darren Sproles that set the record with 2:51 to go.

It was Brees' final pass of the game and it gave him 5,087 yards passing - with one game left. Marino finished with 5,084 yards for the Miami Dolphins in 1984.

As Sproles spiked the ball, Brees thrust his fist triumphantly in the air and started walking toward the sideline while the Superdome crowd went wild and his teammates chased him down. Offensive guard Carl Nicks was the first one to get there and tried to lift Brees onto his shoulder, but couldn't do it as teammates swarmed around.

"If I could have put him on my shoulders and paraded him around the whole stadium I would have done that. He deserves it," Nicks said. "It's like a movie, man. Just a movie ending. It's beautiful. ... You could tell by everyone's reaction after he did it how much people care about that guy. We all love him."

Brees pushed his touchdown total to 276, moving him ahead of Joe Montana (273) and Vinny Testaverde (275) for ninth on the career list. The former Purdue star is the first quarterback in NFL history to pass for more than 5,000 yards twice.

Brees' first scoring pass went for 8 yards to Marques Colston and the second for 9 yards to Jimmy Graham. Graham's TD catch was his 10th of the season, a franchise high for a tight end. In the third quarter, Brees hit Robert Meachem for a score from 24 yards to make it 28-10.

Brees might have broken the record in the third quarter if not for Sproles' 92-yard kickoff return, which set up John Kasay's 29-yard field goal. Brees also threw two interceptions, but New Orleans was still dominant enough to take a big lead.

The game became a romp when Julio Jones was stripped by Scott Shanle and Malcolm Jenkins returned it 30 yards for a score to make it 38-16 in the fourth quarter. The Superdome crowd was in full celebration by then, but the play also meant fans would have to wait until later in the fourth quarter before Brees finally got his chance to break the passing record.

The Saints can earn the No. 2 seed and a first-round playoff bye with a win Sunday over Carolina and a San Francisco loss at St. Louis, which is 2-13.

Atlanta (9-6) is headed to the playoffs as a wild card.

Uncharacteristically, Brees had only a yard passing during a span of a little more than 18 minutes in the second half. Fans howled, "Drewwww!" each time he took the field, and he finally gave them what they wanted after Atlanta failed on a fourth-down try at its own 33. That gave Brees, who needed only 30 yards for the record at that point, just enough space to work with.

The Saints didn't need another score, but Saints coach Sean Payton said he thought giving Brees a chance to go for the record was "appropriate."

Federal judge ends BP's probation for Alaska spill (AP)

ANCHORAGE, Alaska ? A federal judge on Tuesday dismissed prosecutors' argument that a BP subsidiary violated its probation after an oil spill because of another spill on Alaska's North Slope.

Judge Ralph Beistline also lifted BP Exploration (Alaska) Inc.'s probation altogether.

BP had been convicted of negligent discharge of oil in 2007 for a 200,000-gallon spill on the North Slope a year earlier. There was another spill of 13,500 gallons in 2009.

Last month, government lawyers sought to have BP's probation revoked for the latest spill, meaning the probation period could have been lengthened or the company could have faced additional penalties.

In his ruling, Beistline said the government failed to prove the company committed criminal negligence.

"We are pleased with the decision and appreciate the court's attention," BP spokesman Steve Rinehart said in an email to The Associated Press. "We know that the privilege of working in Alaska comes with a responsibility to maintain high standards. We will continue our commitment to running safe and compliant operations."

Emails seeking comment from the U.S. attorney's office in Anchorage were not immediately returned.

Prosecutors said BP's history of environmental crimes in Alaska began in February 2001 when it pleaded guilty to releasing hazardous materials at its Endicott facility on the North Slope. The company was fined $500,000, placed on probation for five years and ordered to create a nationwide environmental management program, prosecutors said.

The March 2006 spill of 200,000 gallons of crude was caused by corrosion, and BP's leak detection system failed to notice it, they said.

The company's guilty plea to a misdemeanor violation of the Clean Water Act in 2007 resulted in three years' probation, a $12 million fine, and restitution and community service payments totaling $8 million to the state of Alaska and the National Fish and Wildlife Foundation.

Prosecutors contended BP violated the conditions of its probation by allowing the 2009 spill from an 18-inch pipe that moved oil, water and gas from drill pads to BP's Lisburne Processing Center. That spill, prosecutors said, leaked 13,500 gallons of oil onto tundra and wetlands.

The government said it was similar to the 2006 spill because BP ignored alarms that warned of the pipe's eventual rupture and leak. The 2009 spill also came after a similar pipe froze and ruptured in 2001, they said, and BP failed to put in place preventative measures that their own experts recommended.

But in his ruling, Beistline wrote: "The investigation concluded, based on the metallurgy report, that the pipeline rupture was not caused by corrosion or improper maintenance, but was caused by a sequence of circumstances, including cooling and warming of ambient temperature after the flow stopped, which led to the freezing of both water and hydrates. This ultimately resulted in increased gas pressure within the pipeline that caused the rupture. Why the flow slowed initially remains a mystery to all."

Beistline said BP followed "accepted industry practices at all relevant times and could not have reasonably expected a blowout similar to the one that occurred on November 29, 2009. Further, the court concludes that once the freeze up was discovered, BP acted reasonably in addressing the problem."

He also said BP's efforts to return the spill site to pre-spill conditions were "impressive."

"An untrained observer would likely be unable to find any indication that a spill had occurred," he wrote, adding there was no evidence that contaminants reached any nearby lakes or Prudhoe Bay.

Police seek motive in Texas family deaths

By the CNN Wire Staff

December 27, 2011 -- Updated 0039 GMT (0839 HKT)

Seven found dead in Texas apartment

STORY HIGHLIGHTS

  • NEW: Shooter was dressed as Santa Claus
  • Police say the family was opening Christmas gifts when the shootings occurred
  • The shooter is believed to be related to the family by marriage, authorities say
  • Autopsies were being conducted Monday, according to police

Dallas (CNN) -- Autopsies were being conducted Monday on seven family members who were fatally shot by a man dressed as Santa Claus at a Christmas gathering, police said.

"The information we have is that this is a family, some of them related by marriage but mostly by blood," Grapevine, Texas, police Sgt. Robert Eberling said Monday. "They have lived in other areas in the (Dallas) metroplex and they came yesterday for a Christmas gathering."

Authorities said the shooter "was one of the individuals inside the apartment that was also deceased," Eberling said. "We know he is a family member ... we are working to find out why exactly this took place. We contacted other family members to piece this together."

The shooter is believed to have been related to the family by marriage, he said. Officers were investigating whether divorce was an aspect of the shooting, he said.

The identities of the victims were expected to be released Tuesday, along with autopsy results, Eberling said.

Police said the group apparently had just finished opening their gifts when the shootings occurred in the living room of the apartment in Grapevine, about 25 miles northwest of Dallas.

Authorities responded to the address Sunday after receiving a 911 call from the apartment, but hearing only an open line, police said in a statement.

The seven bodies -- four female adults and three adult males -- were found when officers entered the apartment. "All victims appear to have gunshot wounds," said the statement.

The victims range in age from 15 to 58 or 59 years old, Eberling said Monday.

"The biggest thing we want to stress is we don't believe this person had barged his way in," Eberling said. "It appears they had all gathered in the living room for your garden-variety Christmas celebration."

CNN's Carma Hassan, Chuck Johnston, and Nick Valencia contributed to this report.
